The Ukrainian parliament adopted legislative amendments to strengthen protection of rights to trademarks and industrial designs. The adopted changes will significantly expand the IP owners’ ability to counter “bad faith” registrations of trademarks and industrial designs.

According to the Decree, if the deadline for performing any actions before Rospatent (filing documents, submitting additional materials, filing petitions, statements, objections, etc.) falls on the period from March 30 to November 30, 2020, the deadline may be extended until December 31, 2020. The extension is also valid for actions related to the payment of official fees.

The proposed revisions are aimed, inter alia, at creating conditions for the Russian scientific and educational organizations accredited by the Russian PTO under which they could conduct a preliminary patent search and patentability assessment of the claimed technical solution. This service will be provided to the applicants at their request. The cost of the service will be determined by the organizations in contracts concluded with the applicants.

On July 26, 2019, Law No. 230-FZ On Amendments to Part Four of the Civil Code of the Russian Federation and Articles 1 and 23.1 of the Federal Law On State Regulation of the Production and Circulation of Ethanol, Alcoholic and Alcohol-Containing Products and on the Limitation of Alcoholic Products Consumption (Drinking) was published. The law will enter into force on July 27, 2020.
